A self-confessed gay prostitute who was arrested in connection with a stealing incident made his case worse when he dressed and presented himself to the Asokwa Police in Kumasi as a female.

Dressed in a mini-skirt and a blouse to match and fitted with artificially enhanced female breasts, the transvestite had initially been arrested in Kumasi last Thursday in connection with a GH¢1,000 theft.

Under Ghanaian law, male same-sex sexual activity is officially illegal. Gay men can also be punished under provisions concerning assault and rape, only if "in public or with minor".
Criminal Code 1960– Chapter 6, Sexual Offences Article 105:
Whoever is guilty of unnatural carnal knowledge— (a) of any person without his consent, is guilty of first degree felony; (b) of any person with his consent, or of any animal, is guilty of a misdemeanor.)
The Constitution of Ghana guarantees the protection of all human rights for Ghanaian citizens "whatever his race, place of origin, political opinion, colour, religion, creed or gender", but does not mention sexuality.[3]

During interrogation, the teenager had initially identified himself as Afia Kesewa, alias Mother, and gave 'her' profession as a commercial sex worker.

However, the vigilance of the Asokwa Police exposed him.

The police, observing some strange behaviour in the suspect, carried out further examination which revealed that 'she' was not a female.

He then gave his real name as Kofi Kusi from Akomadan in the Ashanti Region.
According to the police, the suspect confessed that he was gay.

Briefing graphic.com.gh, the Asokwa District Police Commander, Supt E.A. Akonnor, said on May 9, 2012, a man, Micheal Awuni Atia had reported to the police the theft of his GH¢1,000.

According to the complainant, the said amount had been given to him by his brother, Kwabena Ayane, who worked at the Abinkyi Market, for safekeeping.

Atia, on receiving the money, had gone to have an affair with a prostitute in the Abinkyi area in the evening, in the course of which the money was stolen.

On Thursday morning, Atia identified the prostitute who had stolen the money, but when he confronted 'her', 'her' fellow prostitutes went in to beat him up, allowing 'her' to escape.

According to the complainant, he managed to arrest one of colleagues of the prostitute.
Supt Akonnor said the colleague initially posed as a girl but was exposed after careful examination.
The suspect is said to have told the police that a friend of his had sent him to Kumasi from Akomadan a few weeks ago in search of a job.

Unable to secure any serious job, he decided to dress like a female in order to attract the attention of men.
According to the suspect, his clients who realised that he was not female usually engaged in anal sex with him, from which he made an average of GH¢5 a day.

Meanwhile, the suspect is in police custody pending further investigations.
